NTT-News.com, Waikabubak – Kasie Humas Pengadilan Negeri Waikabubak menyebutkan bahwa Pra Peradilan yang dilakukan oleh kedua penggugat dugaan tindak pidana Korupsi Kegiatan Bimbingan Teknis (Bimtek) aparat Desa dinas Pemberdayaan Masyarakat Desa di Sumba Barat Daya (SBD) pada prinsipnya hanya mempersoalkan surat penetapan tersangka dari Kapolres Sumba Barat.
“Kalau tergugat menang bisa saja masalah ini berakhir disini, tapi bisa juga berlanjut. Kalau hakim putuskan Polisi tidak cukup bukti dan penggugat menang, maka polisi tinggal lengkapi saja alat bukti yang kurang lalu tetapkan lagi tersangka,” kata Kasie Humas, Sony Eko Andrianto, SH, Jumat 26 Juli 2019.
Dia juga menjelaskan bahwa Hakim tidak bisa masuk terlalu dalam ke materi Pokok perkara, hakim posisinya hanya ingin tau, apakah benar penetapan tersangka dalam kasus ini didasari oleh dua alat bukti atau tidak. Sebab dalam KUHAP, penetapan tersangka harus didasari dengan dua alat bukti yang cukup.
“Ketika masalah ini masuk ke Pengadilan, maka hakim punya kewajiban untuk menguji alat bukti yang dipakai Polisi atau para pihak. Jadi jika Hakim Pengadilan Negeri Waikabubak memutuskan nanti bahwa penetapan tersangkanya tidak memiliki dasar alat bukti yang kuat dan dimenangkan penggugat, maka tidak berarti kasus ini berhenti disini saja,” jelasnya.
“Polisi tinggal melengkapi alat bukti lain yang kurang dan kembali menetapkan tersangka, dan apabila berlanjut ke penyidikan dan proses peradilan tidak menutup kemungkinan juga adanya tersangka baru yang ditemukan terlibat berdasarkan hasil pengembangan dari polisi atau jaksa dalam kasus tersebut. Jadi nanti tergantung Polisi,” jelas Soni Eko lagi.
